Please read this Agreement carefully as it governs your use of the www. canvasphotos.biz website - (the 'Website'). 

By continuing to use our Website you are agreeing to the terms set out below. If you are under 18 years of age, you should ask your parents to check these terms before proceeding any further. If you have any questions, please contact us.

These terms and conditions, apply to the usage of the Website and all transactions for the sale of goods on the Website. Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website.

1. Provision of Website Service

The Website is owned and operated by LA Digital Print & Mailing Ltd  trading as canvasphotos.biz whose registered office is at 23 Albany Park, Cabot Lane, Poole BH17 7BX VAT number - 970 0808 25


2. Limited Rights to Use Content

2.1 All material including any intellectual property in it displayed on the Site ("Content") belongs to LA Digital Print & Mailing Ltd or its suppliers. Subject to section 2.2, we give you the right, for your own personal or non-commercial purposes only to:

           Retrieve and display the Content on your PC screen.

           Print individual pages on paper.

           Store individual pages in electronic form on disk/CD.


You do not have the right to store any Content on any server or other storage device connected to an external network. Or make any other use of the Content.

2.2 Most of the Content is owned by LA Digital Print & Mailing Ltd but certain Content is used with the permission of third parties ("Third Party Content") and may be subject to additional restrictions. These restrictions and/or intellectual property rights will be highlighted through hyperlinks on the appropriate pages. You must comply with such restrictions and/or copyrights.


3. Participation

LA Digital Print & Mailing Ltd allows you to submit material to certain areas of the Website. We reserve the right to delete, move and edit any material submitted. You are solely responsible for the material you submit to the Website and by submitting any material you agree that you will not submit any material that:


Contains or links to any unlawful, threatening, abusive, libellous, indecent or otherwise illegal material.


Contains any material which you do not have permission to use (including material which may be protected by copyright, trademarks, database rights or any other form of intellectual property right).


Contains viruses or any other components with harmful or contaminating properties which may affect the Website or any equipment connected to it. Disguises your identity or impersonates any person or entity, including, but not limited to, a LA Digital Print & Mailing Ltd employee, or falsely claims or otherwise misrepresents your affiliation with a person or entity.


4. Online Shopping - Terms and Condition of Sale


4.1 How to place an order

Use the website to upload your picture and follow the 1,2,3 process. After making you selections confirm your order and make the payment. You will be required to create and user name and password for your account.  We will send all correspondence regarding your order to the email address you enter so please be sure to enter accurate contact information. We will only use this email address to communicate with you regarding your order, unless you have subscribed to receive our email newsletter. Any information is stored in compliance with Data Protection Act 1988 and we enforce strict internal security procedures to ensure compliance and prevent unauthorised access.

You can view the status of your orders after logging in with your details.


4.2.1 Product Details, Prices and Promotions

We take great care to present the products on our website as accurately as possible.

The prices for goods displayed for sale on the Website are as set out on the Website and are inclusive of VAT, unless stated otherwise. Where additional charges are made for delivery, they are clearly displayed. Prices and delivery charges displayed are valid and effective for the countries and areas we deliver to.


Although we endeavour to ensure that all pricing and delivery information on the Website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

We reserve the right to adjust prices, offers, products and specifications of products on the Website at our discretion at any time before (but not after) we accept your order. We reserve the right to withdraw any goods from the Website at any time. We will not be liable to you or to anyone else for withdrawing goods from the website.

The images you see depend on your monitor's display and colour capability and may vary as a result. We are therefore unable to guarantee that the pictures of the products you see are an accurate representation of the actual items.


4.2.2 Ordering

Before placing an order you should read these terms and conditions of sale (Section 4) and in particular, the following:

All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note that this email is an acknowledgement and is not an acceptance of your order.


Your order represents an offer to us to purchase a product. LA Digital Print & Mailing Ltd cannot accept your order until you have paid for it in full (including applicable delivery charges). Once you have completed an online purchase, if we are able to accept your order, we will send you an email confirming that the goods ordered have been dispatched to you, unless we have notified you that we do not accept your order or that you have cancelled it in accordance with our returns policy. At this stage payment will be taken and a binding contract between us will exist. In certain circumstances, (section 4.), it will be possible for either you or us to cancel the order. Please read this section for more information.


Whilst we are under no obligation to accept your order, we would normally do so where:

           The product is available.

           The order reflects current pricing.

           Your credit/debit card is approved by your credit/debit card company.


You can access details of your order and any previous orders by logging in to your account once you have registered.


Upon payment, we will confirm acceptance of your order by email which will be sent to the email address you provide on your order details. Whether or not you receive this email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.


4.2.3 Payments

Payment can be made by most major credit or debit cards. Payment will be debited from your account upon or shortly before dispatch of the goods to you.

You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal.


We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

All card payments are processed by Pay Pal.

4.2.4 Availability

There may be certain situations where  the items become unavailable. In the unlikely event of this happening we will inform you by email if any items you have ordered are unavailable. Please note we do not charge your credit or debit card for items not sent to you.


4.3 Delivery Information & Costs


4.3.1 UK Mainland


Standard delivery - Standard delivery is £3.95 to UK mainland addresses excluding the Scottish Highlands (post codes that begin HS, IV, KW, PA and ZE are classed as Scottish Highlands. Please allow up to five working days for delivery.


Express delivery - Our Next Day delivery charge is £8.95. We use a courier, , who aims to deliver to you the next working day. This service is only available in the UK mainland.  If you place an order before 11.00am on a weekday, it will be delivered to you the following working day. If you place your order after 1.00pm, on a Friday, or any time on a weekend or Bank Holiday, please add another working day.  Tracking details will be supplied in your confirmation email.  A signature is required when we deliver your order with Next Day delivery.


Deliveries by Courier

Consignments are delivered anytime between the hours of 9:00am and 6:00pm. Timed delivery options are available, If nobody is available to accept the delivery our carriers will leave a calling card giving you the opportunity to arrange a more convenient delivery time


Our courier does not deliver on Saturday, Sunday or Bank Holidays.

4.3.2 Delivery Status

If you have not received your order or it is late please contact us. We will use our reasonable endeavours to ensure that the estimated delivery times set out in Section 4.3 are met but we cannot accept any liability for late deliveries which are due to circumstances outside of our control.

Once the goods have been received by you, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.


4.3.3 Undeliverable packages

Occasionally we will have a package returned to us because the couriers were unable to deliver it to you. When this happens we will attempt to contact you to discuss.


4.3.4 What if only part of your order has arrived?

Before contacting us please check your paperwork to see whether there is more than one parcel - for example, if it says '1 of 2' or '1 of 3'. This means that we were unable to package your entire order on one package and you should expect a further delivery within the next few days.


4.3.5 What if your order has not arrived at all?

Before contacting us, please check your emails from us or our courier. Please check your junk folder, and ensure that  our email  is added to your safe senders list. Then contact us quoting the order number and date of order. We will then track your order with the relevant party and inform you on the delivery status and next steps.


4.3.6 Collecting your order

Please contact us if you wish to collect your order.


5.1 Online Shopping Cancellation and Returns Policy

Our items are printed to order and returns are only accepted where the item is faulty or damaged.

Please note that we cannot cancel an order once it has been produced


5.2 How to return fault or damaged products once received


      Contact us by email (sales@canvasphotos.biz) or write to us at the address below in section 4.4.3.

once you have contacted us, you will be given instructions on how to return your purchase. We recommend that you use a secure delivery method which requires a signature upon receipt (such as via Royal Mail First Class Recorded Delivery) as you will be responsible for the returned products until they reach us. If the item is faulty we will refund you the cost of returning the product, providing you follow our instructions. All refunds are credited back to the credit card holder's account which was used to make the original purchase.


Due to the complexity of certain products, no refunds or exchanges can be given on selected items until a manufacturing defect is identified. If an item is deemed to be faulty; we will refund the cost of both the outgoing and incoming mail.

If a manufacturing fault has not been determined, we will either:

           Return the item to you.

           Repair or replace the item to a working condition and invoice you for the parts and labour used.

We will always contact you before carrying out either of the above actions.

6. Limited Warranties

LA Digital Print & Mailing Ltd will use its reasonable skill and care in making sure that the Site is available to you on a continual basis. However, because of the number of sources from which LA Digital Print & Mailing Ltd obtains the Content and because of the nature of the Internet, LA Digital Print & Mailing Ltd does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and LA Digital Print & Mailing Ltd makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties. LA Digital Print & Mailing Ltd (The Seller) warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.


6.1 Limitation of Company's Liability

The Company's entire liability (including liability for acts and omissions of its employees, agents and sub contractors) in respect of any breach of its contractual obligations or of any negligence, misrepresentation or other tortious act or omission shall be limited to the contract price for the particular order or orders in issue (excluding postage and carriage costs).


6.2 Consequential or Indirect Loss

The Company shall not be liable for any indirect or consequential loss or damage, loss of profits or goodwill or loss of any kind, other than the direct loss suffered by the Client and subject to the limitation under sub clause 13.1.


6.3 Liability for Death or Personal Injury

Notwithstanding the sub clauses 6.1 and 6.2 above, the Company's liability to the Client for death or injury resulting from its own negligence or that of its employees, agents or sub contractors shall be unlimited.


7. Subscribing to our mailing list to receive our email newsletter

Our site's registration form requires users to give us their contact information (e.g. name and email address) in addition to some demographic information (e.g. postcode). If you request to receive information from LA Digital Print & Mailing Ltd, we will use customer contact information from the registration form to send you electronic newsletters or similar types of information.


8. Technical

You should be aware that information and data may be automatically collected through the use of 'cookies'. Cookies are small text files a website can use to recognise repeat users, allow us to observe behaviour, and compile aggregate data in order to improve our website and to target its advertising. Cookies do not attach to your system or damage your files.


9. Security Policy

The Internet is not a secure medium. However, we have put in place various security procedures as set out in this policy, including firewall security and password protection.

LA Digital Print & Mailing Ltd has its own secure server software that encrypts all of your personal information preventing it being accessed or read by any third party. Our privacy policy ensures complete privacy. We do not disclose your details to any third party unless it is necessary to fulfil your order or unless you have signed up for our email newsletter.

When registering an account with LA Digital Print & Mailing Ltd you will need to include your name and contact details, your billing address and, after your first order, any shipping address different to your billing address. Once entered these are encrypted and sent to our secure server where they are held as long as you have an account with LA Digital Print & Mailing Ltd. At any time you can modify your account details by clicking the 'Login' link on every page. This will take you to the 'My Account' page, where you can view your contact details, address book and order history. Please note, we do not store any credit or debit card information.



Keep your account details and password a secret. As long as you are logged out at the end of a transaction you will have to use your password the next time you wish to make a purchase or make changes to your e-newsletter subscription.


Do not send credit/debit card details by email as this is not secure. Please use our secure order payment service in the online shop.


In the unlikely event of unauthorised card use please be sure to contact your card issuer immediately as per your contractual arrangement with them.


10. Security & E-commerce gateway

Your security and peace of mind are of the greatest importance to us. We endeavour to take all reasonable steps to protect your personal information.

Any sensitive data (including personal data and payment information) you send to us from your computer is securely encrypted and protected using Internet standard encryption technology known as SSL (Secure Sockets Layer.) This process scrambles any sensitive data you transmit to us, preventing it from being intercepted during transmission.

Paypal is our card payment processor. _Paypal will validate your credit card information, and process your payment upon your bank's authorisation. Paypal hold your credit card details in a very secure, encrypted format, allowing us to process any refunds you may require.


11. Links to other Websites

The Site may contain links to other websites and resources. LA Digital Print & Mailing Ltd will make clear where such links are being made. Independent third parties provide these sites. LA Digital Print & Mailing Ltd is not responsible and shall not be liable for the availability or content of these outside resources. Please be aware that LA Digital Print & Mailing Ltd is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave our site and to read the privacy statements/terms and conditions of every website. The privacy policy highlighted in section 8 applies solely to information collected by LA Digital Print & Mailing Ltd

13. General

13.1 There is no specific time limit applying to your access and use of the site. However, LA Digital Print & Mailing Ltd reserves the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.

13.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.

13.3 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

13.4 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

13.5 English law will apply to this Agreement and both you and LA Digital Print & Mailing Ltd agree to submit to the non-exclusive jurisdiction of the English Courts. We are required by law to inform you that sales can be concluded in English only.

13.6 Waiver: No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
